What is the Right to Manage and who can apply
As a leaseholder council tenant, under the Housing Act 1994, you have a Right to Manage.
This means if you are in a qualifying property, you have a right to take over responsibility for managing your housing services from Rotherham Council by grouping together with other tenants to form a Tenant Management Organisation. To do this you would have to follow the Right to Manage process.

Who can apply for the Right to Manage?
To be able to qualify to apply for the Right to Manage, you must be a Leaseholder (own a flat) within a building that adheres to the following:
- It must be self-contained or part self-contained and include at least two flats.
- At least two thirds of the flats must be let to tenants with long leases.
- While the building can be part commercial, the non-residential proportion must not be any more than 25 per cent of the total floor area.
To acquire the right to manage, leaseholders of at least half of the flats within the building must be members of a Right To Manage Company, such as a Tenant Management Organisation.
What is a Tenant Management Organisation (TMO)?
A TMO is an independent legal body who have responsibility for running housing services for a group of homes.
The TMO receives funding from the landlord to run these services. It usually has an elected tenant-led management committee who run the organisation.
