The Council does not disclose the address for the deceased person's property. This is because we consider that the release of the full address and/or value of estate of the deceased may provide an opportunity for a crime to be committed. Under the Freedom of Information Act 2000 the non-disclosure of this information is supported by the engagement of exemption Section 31(1)(a) (Law enforcement – prevention and detection of crime).
Estate Administration
The Treasury Solicitor secures the assets of deceased persons, when:
- there are no apparent living relatives and
- when the estate stands at a certain amount after funeral expenses have been paid
You can look at the Treasury Solicitor's Department website to find out how they deal with these estates.
In terms of the Council, please note that:
- We never give money or property to any family member or friend (unless we are legally directed to do so by the proper authority).
- We can recover our costs as detailed in the Public Health Act Funeral Policy.
- We do not administer the deceased’s estate, but we do recover the costs of the funeral.
