What is succession?
Succession is when someone inherits a tenancy after the tenant dies, an eligible partner or qualifying member of his or her family takes over the tenancy and is known as the successor.
Succession happens automatically if the person is qualified to inherit it. This is known as a Statutory Succession. Successions comply with Housing Law and the Council’s Tenancy Agreement.
Upon the death of one joint tenant, the tenancy automatically transfers to the remaining tenant. The legal term for this is 'Survivorship'.
Succession can only happen once, if the deceased tenant succeeded to the tenancy themselves or was the survivor there cannot be another succession.
Only one person can succeed to a tenancy, joint succession to a tenancy is not possible.
